Seiyu has established this Privacy Policy, the purpose of which is to provide transparent information to Users of the website hosted at the following address: www.seiyu.be (hereinafter the ‘Website’) about how personal data is collected and processed by Seiyu.
The term ‘User’ refers to any user, whether a natural or legal person, who visits or interacts in any way with the Website.
As such, Seiyu determines all the technical, legal and organisational means and purposes of the processing of Users' personal data. To this end, Seiyu undertakes to take all necessary measures to ensure that personal data is processed in accordance with the Law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data (hereinafter, ‘the Law’) and the European Regulation of 26 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter the ‘Regulation’).
Seiyu is free to choose any natural or legal person who processes users' personal data at its request and on its behalf (hereinafter the ‘Processor’). Where applicable, Seiyu undertakes to select a Processor offering sufficient guarantees with regard to the technical and organisational security measures for the processing of personal data, in accordance with the Law and the Regulation.
Processing of personal data
- The use of the Website by Users may result in the communication of personal data. The processing of such data by Seiyu, in its capacity as Data Controller, or by service providers acting on behalf of and for Seiyu, will comply with the Law and the Regulations.
Personal data will be processed by Seiyu, in accordance with the purposes set out below, via:

- Purpose of personal data processing
In accordance with Article 13 of the Regulations, the purposes of personal data processing are communicated to the User and are as follows:
- To ensure the performance of the services offered and agreed upon on the website.
- To ensure the monitoring of the performance of the services offered.
- Carrying out marketing and promotional information activities after obtaining the User's prior consent and until such consent is revoked.
For example, sending promotions on the products and services responsible for the processing.
- Responding to the User's questions.
- Compiling statistics in order to improve the website, the services offered and the internal organisation of operations.
- Improve the quality of the site and products.
Enable better identification of the user's areas of interest.
- Personal data that may be processed
When visiting and using the Site, the User consents to Seiyu collecting and processing the following personal data in accordance with the terms and principles described in this Privacy Policy:
- Information provided by users for contractual purposes and to enable the proper performance of mutual obligations, namely surname, first name, address, IBAN number, bank details and, more generally, any information voluntarily provided by the user when filling in forms or contacting us by telephone, email or other means.

- Consent
By accessing and using the Website, the User declares that they have read and freely, specifically, informedly and unequivocally agreed to the processing of their personal data. This agreement covers the content of this Privacy Policy.
Consent is given by the positive act of the User ticking the box proposing the Privacy Policy via a hyperlink. This consent is a prerequisite for performing certain operations on the Website or for allowing the User to enter into a contractual relationship with Seiyu. Any contract between Seiyu and a User relating to the services and goods offered on the Website is subject to the User's acceptance of the Privacy Policy.
The User consents to the Data Controller processing and collecting, in accordance with the terms and principles set out in this Privacy Policy, their personal data that they provide on the Website or when using the services offered by Seiyu, for the purposes indicated above.
The User has the right to withdraw their consent at any time. Withdrawal of consent does not compromise the lawfulness of processing based on consent given prior to withdrawal.
- Retention period for Users' personal data
In accordance with Article 13 §2 of the Regulation and the Law, the Data Controller shall only retain personal data for as long as is reasonably necessary to fulfil the purposes for which it is processed.
This period is in all cases less than: 1 year.
- Recipients of data and disclosure to third parties
Personal data may be transmitted to Seiyu's employees, collaborators, subcontractors or suppliers who offer adequate data security guarantees and who collaborate with Seiyu in the marketing of products or the provision of services. They act under the direct authority of Seiyu and are responsible for collecting, processing or subcontracting this data.
In all cases, the recipients of the data and those to whom this data has been disclosed comply with the content of this Privacy Policy. Seiyu ensures that they will process this data only for the intended purposes, in a discreet and secure manner.
In the event that the data is disclosed to third parties for direct marketing or prospecting purposes, the User will be informed in advance so that they can give their consent to the use of this personal data.

The role of the DPO is to ensure the proper implementation of national and supranational provisions regarding the collection and processing of personal data.

- User Rights

- Right of access
In accordance with Article 15 of the Regulation, Seiyu guarantees Users the right to access their personal data. Users have the right to obtain access to said personal data as well as the following information:
- the purposes of the processing;
- the categories of personal data concerned;
- the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients who are established in third countries or international organisations;
- where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;
- the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the Regulation, and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject
The Data Controller may charge a reasonable fee based on administrative costs for any additional copies requested by the User.
Where the User makes the request by electronic means (e.g. by e-mail), the information shall be provided in a commonly used electronic form, unless the User requests otherwise.
A copy of the data will be provided to the User no later than one month after receipt of the request.
- Right of rectification
Seiyu guarantees the User the right to rectify and erase personal data.
In accordance with Article 16 of the Regulation, incorrect, inaccurate or irrelevant data may be corrected or deleted at any time. The User shall first make the necessary changes themselves from their user account/other, unless these cannot be made independently, in which case the request may be made to Seiyu.
In accordance with Article 19 of the Regulation, the Data Controller shall notify each recipient to whom the personal data has been disclosed of any rectification of the personal data, unless such communication proves impossible or requires disproportionate effort. The Data Controller shall provide the data subject with information on these recipients if the data subject so requests.
- Right to erasure
The User has the right to obtain the erasure of their personal data as soon as possible in the cases listed in Article 17 of the Regulation.
Where the Data Controller has made the personal data public and is required to erase it pursuant to the previous paragraph, the Controller, taking into account the available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform other Controllers who process such personal data that the data subject has requested the erasure by such Controllers of any links to, or copies or reproductions of, such personal data.
The two preceding paragraphs shall not apply to the extent that such processing is necessary:
- for exercising the right of freedom of expression and information;
- for compliance with a legal obligation which requires processing by Union or Member State law to which the controller is subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
- for the establishment, exercise or defence of legal claims.
In accordance with Article 19 of the Regulation, the Controller shall notify each recipient to whom the personal data have been disclosed of any erasure of personal data or any restriction of processing carried out, unless such communication proves impossible or involves a disproportionate effort. The Controller shall provide the data subject with information on these recipients if the data subject so requests.
- Right to restriction of processing
The User has the right to obtain restriction of the processing of their personal data in the cases listed in Article 19 of the Regulation.
In accordance with Article 19 of the Regulation, the data controller shall notify each recipient to whom the personal data have been disclosed of any restriction of processing, unless such communication proves impossible or involves disproportionate effort. The data controller shall provide the data subject with information about these recipients if the data subject so requests.
- Right to data portability
In accordance with Article 20 of the Regulation, Users have the right to receive from Seiyu personal data concerning them in a structured, commonly used and machine-readable format. Users have the right to transmit these data to another data controller without Seiyu hindering this in the cases provided for in the Regulation.
When Users exercise their right to data portability in accordance with the previous paragraph, they have the right to have personal data transmitted directly from one data controller to another, where technically feasible.
The exercise of the right to data portability is without prejudice to the right to erasure. This right does not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
The right to data portability shall not adversely affect the rights and freedoms of others.
- Right to object and automated individual decision-making
The User has the right to object at any time to the processing of their personal data on grounds relating to their particular situation, including automated data processing carried out by Seiyu. In accordance with Article 21 of the Regulation, Seiyu will no longer process personal data unless there are legitimate and compelling reasons for the processing that override the interests and rights and freedoms of the User, or for the establishment, exercise or defence of legal claims.
Where personal data is processed for marketing purposes, the User has the right to object at any time to the processing of personal data concerning him or her for such marketing purposes, including profiling to the extent that it is related to such marketing.
Where the data subject objects to processing for marketing purposes, the personal data shall no longer be processed for such purposes.
- Right to complain
The User has the right to lodge a complaint regarding the processing of their personal data by Seiyu with the Data Protection Authority, which is competent for the Belgian territory. Further information can be found on the website: https://www.autoriteprotectiondonnees.be.

- Limitation of liability of the Data Controller
The website may contain links to other websites owned by third parties not affiliated with Seiyu. Seiyu is not responsible for the content of these websites or their compliance with the Law and Regulations.
The holder of parental authority must give their express consent for minors under the age of 16 to disclose personal information or data on the website. Seiyu strongly advises persons exercising parental authority over minors to promote responsible and safe use of the Internet. The Data Controller cannot be held liable for collecting and processing personal information and data from minors under the age of 16 whose consent is not effectively covered by that of their legal parents, or for incorrect data - particularly regarding age - entered by minors. Under no circumstances will personal data be processed by the Data Controller if the User specifies that they are under 16 years of age.
Seiyu is not responsible for the loss, corruption or theft of personal data caused in particular by the presence of viruses or as a result of cyber attacks.
- Security
The Data Controller implements organisational and technical measures to ensure an appropriate level of security for the processing and collection of data. These security measures depend on the costs of implementation in relation to the nature, context and purposes of the processing of personal data.
The Data Controller uses standard encryption technologies within the IT sector when transferring or collecting data on the Website.
Modification of the Privacy Policy
- Seiyu reserves the right to modify this Privacy Policy in order to comply with legal obligations in this area. Users are therefore invited to consult the Privacy Policy regularly in order to be aware of any modifications and adaptations. Such modifications will be posted on the Website or sent by email for the purposes of enforceability.
- Applicable law and competent jurisdiction
This Privacy Policy is governed exclusively by Belgian law. Any dispute shall be brought before the courts of the judicial district of Seiyu's registered office.
